General Terms and Conditions of the Linde Homecare Store

These contractual terms and conditions relating to distance contracts for the purchase and sale of products and services concluded through the website https://lindehomecare.com/pt (hereinafter referred to as the "Linde Homecare Store Web Portal") are established between:

Linde Saúde, Lda., with registered office at Rua da Lionesa, no. 446, premises C2 and C4, 4465-671 Leça do Balio, Portugal, VAT number 500125546, and the customer.

Article 1 – Scope of Application

These general terms and conditions of sale apply to the purchase of products and services through the Linde Homecare Store Web Portal.

The purchase of any product from the Linde Homecare Store implies acceptance of this information and these general terms and conditions of purchase, which are available on the Web Portal at any time. Therefore, users should carefully read these general terms and conditions before making a purchase.

Article 2 – Contract Terms

The user must be at least 18 (eighteen) years old to create an online account and make purchases from the Linde Homecare Store. The user must use the Linde Homecare Store Web Portal in accordance with applicable legislation.

The Web Portal allows users to purchase healthcare products and services. The purchase of products and services subject to a medical prescription is not permitted.

The contract is concluded in Portuguese.

Article 3 – Prices and Delivery Costs

The prices of the products are indicated on the Linde Homecare Store Web Portal, together with the description of each product, and are expressed in euros (€).

Prices include Value Added Tax (VAT), but do not include shipping costs, which are presented separately.

Delivery in Portugal

Article 4 – Delivery of Orders

Orders will be delivered once the order and the corresponding payment have been confirmed.

The delivery times indicated are estimates and may vary depending on the destination, product availability, circumstances related to transportation or other factors that may affect the delivery process.

Delivery times start once the order and the corresponding payment have been confirmed.

If an order contains several products with different availability or delivery times, delivery may take place in stages or be subject to the timeframe applicable to the product with the longest availability period.

In the event of a delay in the delivery of an order, the user will be informed and will, in such case, have the right to terminate the contract within a maximum period of 14 days.

The company will only deliver to valid addresses in Portugal.

Ownership of the products will only be transferred to the user once the agreed price has been paid in full. Until then, Linde Saúde will retain ownership of the products.

Article 5 – Payment Methods

We accept VISA, MasterCard, MB WAY and PayPal as payment methods.

Your payment is processed through an authorised service provider, and all information required to process the payment is therefore transferred to that service provider.

Accordingly, Linde Saúde, through its Web Portal https://lindehomecare.com/pt, will not have access to your banking details.

By making a purchase through the Linde Homecare Store Web Portal, the user agrees that the service provider may collect information about their credit status from their local bank.

The contracted service provider is Shopify.

Article 6 – Right of Withdrawal and Returns

The period for returning or exchanging a product is 14 calendar days from the date of receipt of the product. Notification of the exercise of this right must be sent before the expiry of this period.

Linde Saúde, Lda. reserves the right to refuse the return of products that are not in the same condition in which they were received.

In particular, the products must be complete, in the same condition in which they were sold, without signs of improper use, in their original packaging and in good condition, accompanied by the relevant instruction manual and all accessories included with the product.

Article 7 – Warranty, Repair and Replacement

All products sold through the Linde Homecare Store at https://lindehomecare.com/pt are covered, in accordance with applicable law, by a 3 (three)-year warranty from the date of delivery, in accordance with Decree-Law No. 84/2021 of 18 October, which regulates consumer rights in the purchase and sale of goods, digital content and digital services, transposing Directives (EU) 2019/771 and (EU) 2019/770.

If the product has a defect or has been supplied incorrectly and does not comply with the provisions of the contract, the user may choose to have it replaced or repaired, in accordance with applicable law.

To arrange for the replacement or repair of the product, the user must first contact our Customer Service by form or by letter:

Article 8 – Liability

The company shall be liable for damages in accordance with the applicable legal provisions.

The company shall be fully liable for damages caused by wilful misconduct or gross negligence on the part of its directors and, in general, for damages resulting from any culpable breach of the contractual provisions.

Any injured person shall be entitled to compensation for damages caused by products purchased through the online store and shall, in all cases, be required to prove the existence of the defect, the damage and the causal link between them.

The manufacturer's civil liability is limited to the compensation amounts established by applicable legislation.

Article 9 – Applicable Law and Jurisdiction

These Terms and Conditions, as well as all contracts concluded under them, shall be governed by Portuguese law.
